Terms of Service
1. Agreement to Terms
By accessing or using RetouchFlow (https://retouchflow.com), including our website, API, mobile applications, and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Golden Global Hawks ("Company," "we," "us," or "our"), operating as RetouchFlow.
2. Description of Service
RetouchFlow is an AI-powered photo retouching platform that allows users to:
- Upload photos for automated AI enhancement (face retouching, skin smoothing, lighting correction)
- Process photos individually or in batch
- Download enhanced results in various resolutions
- Publish retouched photos to social platforms (Instagram, OnlyFans)
- Access the Service via web interface or API
AI processing is performed using third-party models including GFPGAN, CodeFormer, and Real-ESRGAN via the Replicate API.
3. Eligibility
You must be at least 18 years of age to use the Service. By using RetouchFlow, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at [email protected] if you suspect unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription Plans and Pricing

5.1 Billing
- All paid subscriptions are billed monthly in advance via Stripe
- Prices are in US Dollars unless otherwise stated
- You authorize us to charge your payment method on file for recurring subscription fees
- Stripe handles all payment processing; we do not store your full credit card details
5.2 Free Trial
If a free trial is offered, you will not be charged until the trial period ends. You may cancel before the trial expires to avoid charges.
5.3 Price Changes
We may change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle. Continued use after a price change constitutes acceptance.
6. Refund Policy
- Within 7 days of first payment: You may request a full refund if you have not processed more than 50 photos on your paid plan.
- After 7 days: Refunds are issued at our sole discretion and only in cases of Service malfunction or billing error.
- No refunds for partial months, unused photo quotas, or voluntary cancellation mid-cycle.
- Chargebacks: If you initiate a chargeback instead of contacting us, your account will be immediately suspended pending resolution.
To request a refund, contact [email protected] with your account email and reason for the request.
7. Cancellation
- You may cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of your current billing period
- You retain access to paid features until the end of the period you have already paid for
- Upon cancellation, your account reverts to the Free plan
- Photos in your account remain accessible for 30 days after cancellation, then are deleted
8. Acceptable Use Policy
You agree NOT to use RetouchFlow to:
- Upload illegal content — including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content that violates any applicable law
- Process photos without rights — you must have legal rights or permission to retouch any photo you upload
- Create deepfakes or deceptive media — using the Service to create misleading imagery intended to deceive, defraud, or harass
- Impersonate others — retouching photos to misrepresent identity for fraudulent purposes
- Abuse the Service — including automated scraping, circumventing rate limits, exploiting vulnerabilities, or interfering with Service infrastructure
- Resell without authorization — reselling Service access outside of the Agency plan's white-label offering
- Violate third-party rights — infringing on copyrights, trademarks, privacy rights, or other intellectual property rights
- Distribute malware — uploading files containing viruses, trojans, or other harmful code
- Harass or harm — using retouched images to bully, harass, defame, or harm any individual
We reserve the right to remove content and suspend or terminate accounts that violate this policy without notice or refund.
9. Intellectual Property
9.1 Your Content
You retain all ownership rights to photos you upload ("User Content"). By uploading photos, you grant RetouchFlow a limited, non-exclusive, worldwide license to process, store temporarily, and deliver your photos solely for the purpose of providing the Service.
This license terminates when your photos are deleted from our systems.
9.2 Our Service
RetouchFlow, including its design, code, AI models, brand, logo, and documentation, is owned by Golden Global Hawks. Nothing in these Terms transfers any intellectual property rights in the Service to you.
9.3 AI-Enhanced Output
You own the retouched output generated from your photos. We claim no ownership over enhanced images. However, the AI enhancement techniques, models, and processes used to create the output remain our intellectual property (or that of our third-party AI providers).
9.4 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free license to use that feedback for any purpose without obligation to you.
10. Social Publishing
10.1 Instagram Integration
RetouchFlow offers publishing to Instagram via the Instagram Graph API. By connecting your Instagram account:
- You authorize RetouchFlow to post on your behalf
- You remain responsible for all content posted to your account
- You must comply with Instagram's Terms of Use and Community Guidelines
- We are not responsible for actions taken by Instagram regarding your content or account
10.2 OnlyFans Integration
RetouchFlow offers publishing to OnlyFans via session-based API access. By connecting your OnlyFans account:
- You authorize RetouchFlow to upload content on your behalf
- You are solely responsible for compliance with OnlyFans' Terms of Service
- You confirm you have the right to publish all content
- We are not responsible for OnlyFans account actions, payouts, or disputes
10.3 Social Account Security
We access social platforms using industry-standard authentication methods. However, you acknowledge that connecting third-party accounts carries inherent risk, and you are responsible for maintaining the security of your social media credentials.
11. API Usage (Agency Plan)
Agency plan subscribers may access the RetouchFlow API subject to:
- Rate limits as documented in our API documentation
- API keys must be kept confidential; you are responsible for all usage under your key
- No excessive load — do not use the API in a manner that degrades Service performance for other users
- Attribution — white-label use is permitted under the Agency plan, but you may not claim to have built the underlying AI technology
12. Data Retention and Deletion
- Uploaded photos are stored on AWS S3 (us-east-2 region) and are automatically deleted 30 days after processing
- Processed photos follow the same 30-day auto-deletion policy
- Account data (email, name) is retained for the lifetime of your account and deleted within 30 days of account deletion
- Payment records are retained as required by tax and financial regulations (typically 7 years)
- You may request early deletion of your photos at any time by contacting [email protected] or using the delete function in your account

Each third-party service is governed by its own terms and privacy policy. We are not responsible for the practices of third-party services.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, AND SECURITY.
AI-powered photo enhancement is inherently imperfect. Results may vary based on input photo quality, lighting, resolution, and other factors. We do not guarantee specific outcomes.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Golden Global Hawks' total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to RetouchFlow in the 12 months preceding the claim, or $100, whichever is greater.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
16. Indemnification
You agree to indemnify, defend, and hold harmless Golden Global Hawks, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, violation of these Terms, violation of any third-party rights, or content you upload, process, or publish through the Service.
17. Dispute Resolution
17.1 Informal Resolution
Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
17.2 Arbitration
If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
17.3 Class Action Waiver
You agree to resolve disputes individually. You waive any right to participate in a class action, class arbitration, or representative proceeding.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
19. Modifications to Terms
We may update these Terms from time to time. For material changes, we will notify you via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance.
20. Termination
You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms, fraudulent activity, non-payment, or extended inactivity. Upon termination, your photos will be deleted within 30 days.
21. General Provisions
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Golden Global Hawks regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Failure to enforce any provision does not constitute a waiver.
